Terms of Use

The material published on the Digital Education Research Network (DERN) (specifically the research reviews and research briefs) is subject to copyright under the Copyright Act 1968 (Cth), and is owned by the Australian Council for Educational Research (ACER) or, where indicated, by a party other than ACER.

Conditions

Limitation of liability

DERN through ACER has compiled the material on this website in good faith and has endeavoured to ensure that all material is accurate and does not breach any entity’s rights at the time of its inclusion. However, the material may contain unintentional errors and is provided ‘as is’.

To the maximum extent lawful, ACER:

a.    excludes all warranties in respect of this website and the material contained on it; and
b.    is not liable for:

i.    any loss or damage however caused resulting from your use or inability to use this website or the material; or
ii.    any incidental, special or consequential damages arising from the use or inability to use the website or the material contained on it.

Registration and login names

In order to access the full range of services, comment and submit content to DERN, you will be required to subscribe to DERN services.

ACER recommends that applicants subscribe online using a pen name or pseudonym as their Screen Name (not their real name). Users should be aware that posted content, comments or links can remain online indefinitely and may be found through search engines or online archives. Users must not impersonate another living person or registered user.

When subscribing, a genuine email address must be provided. You will be asked to provide your real name and some personal details.

Subscribers to the full range of DERN services will not have access until payment of the annual subscription is received.

DERN through ACER may refuse subscription of users based on:

DERN through ACER may not accept any subscription that it suspects is being made by or on behalf of a member who has been suspended for violation of the behaviour code.

Passwords and security

As a subscribed user of DERN, you may receive or establish one or more passwords. You are responsible for maintaining the confidentiality and security of your password(s).

Accordingly, a user understands and agrees to be fully responsible for all actions and submissions made from the user’s registered DERN account.

If a DERN user becomes aware of any unauthorised use of an account, DERN should be notified immediately.

Termination of account

A user can close an account with DERN at any time by unsubscribing, where that option is available or by notifying DERN at dern@acer.edu.au. If a user chooses to close their account during a subscription period no refund will be issued. Users should note, however, that a user’s posting contributions may still be available on the DERN site after the account has been closed.

If DERN through ACER reasonably believes a user has breached these Terms of Use, DERN through ACER reserves the right to restrict access to or terminate the user’s account, with or without notice, and without any liability to the user.

User participation

A user may be held legally responsible for the comments and content submitted to DERN.

All material published on DERN is at DERN’s sole discretion.
